The Mississippi Justice Institute, a legal advocacy organization, has cautioned Tupelo, Mississippi officials against introducing food truck regulations, according to The Daily Journal. The organization sent a letter to city officials saying regulation could unfairly interfere with the local economy.
Shadrack White, the organization’s director, said that food truck regulations tend to arbitrarily deny citizens the right to earn a living, unfairly privilege some businesses over others, and result in inconsistent enforcement.”
City council members want to require food trucks to keep a specified distance away from established eateries. White emphasized concern about this requirement and cited litigation in other cities over the issue.
Mayor Jason Shelton said he will cooperate with the city council on an ordinance, but he is not sure how the city will proceed.
