The Institute for Justice has filed a lawsuit on behalf of food truck owners to challenge food truck regulations in South Padre Island, a Texas resort town, claiming the law is unconstitutional.
Arif Panju, managing attorney for the Texas office of the institute, said the law denies food truck owners the right to earn an honest living and receive meaningful protection under the Texas constitution, according to the Brownsville Herald.
Food truck owners are required to ask permission from a local restaurant owner to operate a food truck.
The lawsuit is also challenging the Island's limit of 12 active food truck permits.
