Illinois Supreme Court will hear 2012 lawsuit against Chicago's food truck law

January 21, 2019

The Illinois Supreme Court on Wednesday will hear the case of a Chicago food truck owner, who claimed the city's food truck regulations were too restrictive and forced her to stop operating her food truck, according to nbcchicago.com. The city does not permit food trucks to park within 200 feet of a restaurant or other business that serves food, and it requires them to have a GPS tracking device.

Laura Pekarik, who formerly owned Cupcakes for Courage, sued the city over the rules with the support of the Institute for Justice. The lawsuit — LMP Services Inc. v. the city of Chicago — was filed in 2012, after the city introduced its food truck regulations.
