Institute for Justice sues Louisville lawmakers over food truck regs

The Institute for Justice is suing four Louisville lawmakers for not complying with a public records request for communications related to food truck legislation, according to a whas11.com report. The suit names Metro Council members Pat Muhvihill, Scott Reed, Brandon Coan and Barbara Sexton-Smith.

The suit claims the lawmakers have sought to cripple food truck operators with regulation, beginning in 2017 when the city passed but soon repealed a law requiring the trucks be 150 feet from restaurants that sold similar food.

Arif Panju, an attorney for the institute, said Kentucky Attorney General Andy Beshear in May ruled the council members had violated the Open Records Act.

A new ordinance has been presented to regulate how food trucks can operate and where they can park.

A council spokesperson declined to comment until the suit has been reviewed.
