Lawsuit against Baltimore food truck restrictions heads to court

A lawsuit by food truck owners against Baltimore will head to court.

On Monday, Baltimore City Circuit Court Judge Yolanda Tanner ruled the case should head to a trial, which will begin September 28, according to The Baltimore Business Journal. Two weeks ago, lawyers for both parties sought an immediate ruling from the judge.

The food trucks want a city law overturned that prohibits trucks from operating within 300 feet of a restaurant selling similar food. Nikki McGowan of MindGrub Café and Joey Vanoni of Pizza di Joey filed the suit. Food truck owners face a fine of up to $500 and having their license revoked.

The Institute for Justice, an Arlington, Virginia-based nonprofit law firm, is representing the plaintiffs.

The food truck owners say the law discourages healthy competition and prevents them from operating in certain neighborhoods.
