New Jersey developer sues city over food truck rules

A Jersey City, New Jersey real estate developer is suing the city over an ordinance that has designated zones where food trucks can operate, according to an msn.com report. Under the ordinance, food trucks can park on parts of Montgomery Street, Sussex Street and Bergen Avenue.

The company, Mack-Cali, claims the ordinance is not consistent with state motor vehicle laws. It claims the parking zones conflict with state laws prohibiting vehicles from parking within 25 feet of the nearest crosswalk or curb, 10 feet of a fire hydrant and 50 feet of a stop sign.

Mack-Cali owns 101 Montgomery, which is a block west of the Montgomery Street food tuck zone.

In September, food truck owners objected to the $200 daily fees required to park in the Montgomery and Sussex street zones. Food truck parking fees are currently suspended.

Fifteen food truck owners issued a statement Tuesday saying they never wanted to park on Montgomery Street.
