Trial begins in food truck lawsuit against Baltimore restrictions

A pair of food truck owners suing the city of Baltimore, Maryland over food truck restrictions are having their day in court, according to the Baltimore Business Journal.

The trial for the lawsuit brought by Joey Vanoni, owner of Pizza di Joey, and Nikki McGowan, owner of the MindGrub Café truck, began Thursday in Baltimore Circuit Court.

The food truck owners claim a law barring food trucks from operating within 300 feet of any brick-and-mortar business that offers the same food or service is unconstitutional and hurts their businesses. 

City attorneys claim the truck owners can't prove they are negatively affected by the law.

Vanoni and McGowan are being represented by the public interest law firm Institute for Justice. They first filed their lawsuit in May 2016 and went to court this summer to ask for a summary judgment, but Baltimore City Circuit Court Judge Yolanda Tanner denied the request.
