Wisconsin food truck owners battle town food truck ban

The owners of a Wisconsin food truck hope to resume operations now that a county judge has ruled against the town's request to dismiss their lawsuit challenging its food truck restrictions.

Gibraltar, Wisconsin prohibits food trucks, according to a Green Bay-Press report.

The owners of White Cottage Red Door LLC, a farm market and specialty food store, wanted to sell food from a food truck in 2017 after gathering state and county permits. The town then updated its zoning code to ban food trucks and sent a letter to the county to cancel the truck's permit.

A town constable visited the truck a few weeks after it opened and advised the owners they would be fined $500 per day.

The suit questions whether the town can ban a business that is permitted by both the county and the state. It also seeks to clarify if the town's law violates constitutional and state law.
