A food truck ban has been repealed in Miami Gardens, Florida, following a complaint by the Institute of Justice that alleged the ban violated Florida laws.
Now, the Institute is calling on Aventura, Florida to also end its food truck ban, according to a press release from the Institute of Justice.
Florida passed a law in 2020 that forbade any local governments from prohibiting food trucks from operating in the city. Miami Gardens allegedly would fine property owners $500 daily for hosting food trucks. Aventura has a city zoning code that states that any business not express authorized is prohibited, which includes food trucks.
"The Florida Legislature settled this issue six years ago: cities cannot ban food trucks, period," said IJ Attorney James Odell, in a letter to Aventura. "Aventura doesn't get to opt out of state law due to a mistaken belief that food trucks hurt local brick-and-mortar restaurants."
